It applies to visitors of our website (maineffortconsulting.com), recipients of our email communications, and users of our encrypted email portal (secure.maineffortconsulting.com).

3. Information We Collect

3.1 Website Visitors

When you visit our website, Squarespace (our hosting provider) may collect standard web analytics data including pages viewed, time on site, referring URL, browser type, and approximate geographic location. We do not use third-party tracking cookies, advertising pixels, or retargeting services. We do not sell or share website visitor data with third parties for advertising purposes.

3.2 Contact Form and Email Inquiries

When you contact us through our website, email, or phone, we collect the information you provide: your name, email address, phone number, company name, and the content of your message. This information is used solely to respond to your inquiry and, if applicable, to scope a potential consulting engagement.

3.3 Encrypted Email Portal

Our encrypted email portal at secure.maineffortconsulting.com is powered by Tuta (Tutao GmbH, Hanover, Germany). When you receive an encrypted email from us and access it through the portal, Tuta processes a minimal amount of data necessary to deliver the message. Tuta cannot read the content of encrypted messages. For details on Tuta's data handling, refer to Tuta's privacy policy at tuta.com/privacy-policy.

3.4 Client Engagement Data

During consulting engagements, we collect operational data, interview notes, organizational documents, and related materials necessary to complete the engagement scope. Client engagement data is governed by the Statement of Work and, where applicable, a Mutual Non-Disclosure Agreement signed before the engagement begins. Our internal Client Data Security Policy defines how this data is classified, stored, and destroyed.

4. How We Use Your Information

We use the information we collect for the following purposes:

•       To respond to inquiries and schedule consultations

•       To prepare proposals and scope consulting engagements

•       To deliver consulting services as defined in the Statement of Work

•       To send follow-up communications related to completed engagements

•       To improve our website and services

•       To comply with legal and regulatory obligations

5. How We Protect Your Information

We take data security seriously. Our practices include:

•       End-to-end encrypted email for confidential communications (Tuta, post-quantum encryption)

•       Encryption at rest (AES-256 minimum) and in transit (TLS 1.2+) for all stored client data

•       Two-factor authentication on all accounts that access client data

•       Role-based access controls limiting data access to personnel actively working on an engagement

•       Defined retention periods and destruction procedures for all record types

•       A minimum-necessary data collection principle: we collect only what is required to complete the engagement scope

6. Data Retention

We retain different categories of records for different periods based on legal requirements, professional liability considerations, and business need. Key retention periods include:

•       Signed contracts and final deliverables: 7 years after engagement close

•       Interview notes and working files: 2 years after engagement close

•       Financial records: 7 years per IRS requirements

•       Website inquiry data: 2 years from last contact

After the retention period expires, records are permanently deleted using methods appropriate to the data classification.

7. Information Sharing

We do not sell, rent, or share your personal information with third parties for marketing purposes. We may share information in the following limited circumstances:

•       With subcontractors or associates working on your engagement, who are bound by a Non-Disclosure Agreement before receiving any client data

•       With service providers who support our operations (hosting, payment processing, email), who process data only as necessary to provide their services

•       When required by law, court order, or government regulation

•       To protect our legal rights or to respond to legal claims

8. Your Rights

You have the right to:

•       Request access to the personal information we hold about you

•       Request correction of inaccurate information

•       Request deletion of your personal information, subject to legal retention requirements

•       Withdraw consent for communications at any time
